These Terms of Use govern access to the Snowbird Security, LLC website. By using the website, you agree to these terms. If you do not agree, do not use the website.
Website information only
The website provides general information about Snowbird Security and its services. Website content is not legal, safety, law-enforcement, insurance, employment, or professional risk-management advice. Conditions differ by property and assignment, and information on the website may not address your circumstances.
No contract or guarantee
Submitting a form, receiving a communication, scheduling a discussion, or receiving preliminary information does not create a security-services contract, employment relationship, agency relationship, fiduciary duty, or obligation to provide service. Services begin only under a written agreement signed by authorized parties and are subject to assessment, staffing, location, licensing, insurance, lawful authority, contract terms, and availability.
Security services can deter activity, improve observation, support response, and reduce risk, but no security company can guarantee that every crime, loss, injury, fire, emergency, disruption, or other incident will be prevented, detected, or resolved.
Emergencies
This website and its forms are not monitored as an emergency service. Do not report an emergency through the website. Call 911 or the appropriate emergency authority.
Permitted use
You may use the website for lawful informational, contact, employment, and service-inquiry purposes. You may not interfere with the website; attempt unauthorized access; submit malicious code; misrepresent identity or authority; scrape or copy substantial content; use the website to threaten, harass, defraud, or violate law; or submit confidential, classified, medical, financial-account, access-credential, or other sensitive information that the form does not request.
Intellectual property
The Snowbird Security name, logos, brand elements, original website copy, layout, graphics, downloadable resources, photographs, generated images, and code are owned by Snowbird Security or used with permission or license. No rights are granted except a limited, revocable right to view and use the website for its intended purpose. Client and partner marks remain the property of their respective owners and are displayed with permission.
Third-party links
The website may link to HubSpot, Netlify, GuardsPro, Indeed, social platforms, and other third-party services. Snowbird Security does not control third-party websites and is not responsible for their content, availability, security, or practices. A link is not an endorsement except where expressly stated.
User submissions
You represent that information you submit is accurate to the best of your knowledge and that you have authority to submit it. You grant Snowbird Security permission to use the submission to respond, evaluate a request, manage recruiting, maintain records, and conduct related business activities. Do not submit trade secrets or highly sensitive operational security information through an initial inquiry form.
Disclaimer of warranties
To the fullest extent permitted by law, the website is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of accuracy, completeness, availability, merchantability, fitness for a particular purpose, title, or noninfringement. This disclaimer does not exclude warranties or rights that cannot lawfully be waived.
Limitation of liability
To the fullest extent permitted by applicable law, Snowbird Security and its owners, managers, employees, agents, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of data, loss of business, or loss of profits arising from or related to use of or inability to use the website. For claims arising solely from the website and not from a separate written service agreement, aggregate liability will not exceed the greater of amounts paid specifically for website access during the six months before the event giving rise to the claim or one hundred dollars. These limits do not apply where prohibited by law and do not alter liabilities or remedies under a separate signed agreement.
Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Snowbird Security from claims, losses, costs, and expenses arising from your unlawful misuse of the website, violation of these terms, infringement of another person’s rights, or information you submit without authority. This provision does not require indemnification for conduct that cannot lawfully be shifted to you.
Maine law and venue
These website terms are governed by Maine law, without regard to conflict-of-law principles, except where federal law applies or applicable law provides nonwaivable rights. Subject to those rights, disputes arising solely from website use will be brought in a court of competent jurisdiction in Maine, with state-court venue in Franklin County when permitted. Nothing in these terms waives protections under Maine’s Unfair Trade Practices Act or other rights that cannot lawfully be waived.
Changes, severability, and waiver
We may update the website and these terms. If a provision is unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will remain effective. Failure to enforce a provision is not a waiver.
